By accessing or using TravelWeather, you agree to these Terms to the extent permitted by applicable law.

TravelWeather provides travel-planning information based primarily on historical and long-term climate data and related travel information. TravelWeather does not provide weather forecasts, travel bookings, professional meteorological advice, safety guarantees or assurances concerning future weather or travel conditions.

Climate information describes historical or typical conditions. Actual conditions may differ.

TravelWeather is provided for personal, non-commercial travel research and other uses expressly authorized by us.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to access and use TravelWeather through its ordinary user interface. No other rights are granted by implication.

Except for third-party materials and data identified as such, TravelWeather and its original content, software, user-interface elements, graphics, visualizations, written material, destination classifications, compilations, selection and arrangement of information, database structure and other protectable elements are owned by or licensed to TravelWeather.

Nothing in these Terms claims ownership of facts, public-domain material, third-party data or other material that is not legally protectable. No license to trademarks, branding, copyright, database rights or other intellectual-property rights is granted except for the limited right to use the service described above.

Except where expressly authorized by TravelWeather in writing or required by applicable law, you may not use automated means to access, obtain, reproduce, collect, monitor, index or extract content or data from TravelWeather other than ordinary search-engine crawling that complies with our published machine-readable instructions.

Access technically possible through a public webpage does not constitute permission for an automated use prohibited by these Terms.

• scraping, crawling, harvesting or bulk downloading;
• systematic or repeated querying intended to reconstruct a dataset or database;
• bypassing rate limits, access controls, technical restrictions or machine-readable usage instructions;
• using automated agents to copy destination profiles, climate tables, rankings, classifications, graphics or other substantial collections of TravelWeather content;
• reproducing or extracting content to create, populate, improve or maintain a competing or substitute product, service or database; and
• using content for machine learning, artificial-intelligence training, model development, text and data mining, embedding generation, dataset creation or similar computational analysis except where we have expressly licensed that use or applicable law does not permit the relevant right to be reserved.

All rights relating to text and data mining, machine learning and artificial-intelligence training are expressly reserved to the fullest extent permitted by applicable law.

For purposes of Article 4(3) of Directive (EU) 2019/790 and applicable national implementing law, including section 44b(3) of the German Copyright Act (Urheberrechtsgesetz), TravelWeather expressly reserves the use of copyright-protected works and other protected material made available through the service for text and data mining. This reservation includes use for the training, development, evaluation or improvement of artificial-intelligence or machine-learning systems.

We may express this reservation through machine-readable measures in addition to these Terms. Nothing in this section limits uses that cannot lawfully be restricted or reserved.

To the extent that databases or substantial portions of databases made available through the service qualify for protection under applicable law, all applicable database rights are reserved.

In jurisdictions applying Directive 96/9/EC on the legal protection of databases, including Germany, TravelWeather reserves, to the extent applicable, the rights of the database maker in databases for which it has made the legally required investment in obtaining, verifying or presenting their contents.

Without authorization, users may not extract or reutilize all or a substantial part of a protected database. Repeated or systematic extraction or reutilization of insubstantial portions is also prohibited where it conflicts with normal exploitation of the database or unreasonably prejudices the legitimate interests of the database maker. This provision does not claim exclusive rights in individual facts or third-party material merely because they appear within a database.

TravelWeather incorporates or derives information from multiple sources. Rights in third-party source material remain with their respective owners.

Our rights in our own databases, compilations, software, graphics, analysis, classifications and presentation do not imply ownership of underlying third-party facts or data.

Where the service displays travel advisory information, it is supplied by official government sources as additional travel-planning context. It is separate from our climate information and does not alter the underlying climate measures.

The guidance may be intended for citizens or residents of the issuing government, may change at any time, and may not apply uniformly across all regions of a country. We do not provide security, legal, or travel-safety advice. Before travelling, consult the original issuing authority and other appropriate current sources.

TravelWeather is designed as a travel-planning aid. Climate statistics, rankings, destination assessments and other information may contain errors, omissions, source limitations or differences from actual future conditions.

Before making material travel, safety, health or financial decisions, users should consult appropriate current and authoritative sources.

We may modify, correct, suspend or discontinue any part of TravelWeather and may change its content, methodology, functionality or data sources.

We do not guarantee that the service will always be available, uninterrupted or error-free.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

For users acting in the course of a business or profession, and to the maximum extent permitted by law, TravelWeather is not liable for indirect, incidental, consequential or special losses arising from use of or inability to use the service.

For consumers in Germany and other jurisdictions whose mandatory law restricts contractual limitations of liability, the applicable mandatory statutory rules remain unaffected. In particular, these Terms do not exclude liability that cannot lawfully be excluded, including liability for intent, gross negligence, or injury to life, body or health where applicable.

We may restrict automated access, block technical access, revoke permissions or pursue other available remedies where we reasonably believe these Terms or our intellectual-property, database or access rights are being violated.

Nothing in these Terms expands any statutory cause of action beyond what applicable law provides.

For users acting in the course of a business or profession, these Terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law principles, and disputes shall be subject to the courts specified by applicable agreement or law.

For consumers, any choice of law in these Terms does not deprive the consumer of mandatory protections available under the law that would otherwise apply. Nothing in these Terms restricts a consumer’s right to bring proceedings in a court that applicable consumer law requires to remain available.

We may update these Terms from time to time. The current version and its effective date will be published on the service. Where applicable law requires additional notice or consent to a material change, we will provide it.
